Rental Agreement & Terms

Last updated October 21, 2026

This Rental Agreement applies to every refrigerated trailer rental from FrostBox Rentals. The equipment details, rental dates, pickup and return times, and fees are filled in from your booking confirmation. Please read it carefully before booking.

1. Agreement and Parties

This Rental Agreement ("Agreement") is between FrostBox Rentals LLC ("Company", "we", "us") and the person named on the booking ("Renter", "you"). It takes effect when you place a booking, whether on our website or with our staff, and it covers the equipment described on that booking.

The booking record is part of this Agreement. The equipment make, model, serial number, identifying marks, rental dates, pickup and return times, and rental fee are those shown on your booking confirmation and invoice. Those details are filled in from your checkout and supersede any blank or placeholder text you may see in a sample copy of this Agreement.

By booking, taking possession of, or using the equipment, you confirm you are at least 18 years old, have read this Agreement, and accept it. The person named on the booking is responsible for the equipment for the entire rental period, including if someone else tows or uses it with your permission.

2. Rental Equipment and Condition

We will provide the refrigerated trailer, and any generator or accessories listed on your booking, clean, in good working order, and with the refrigeration system operating at the agreed temperature. You are responsible for inspecting the equipment at pickup and noting any existing damage or defect on the pickup checklist before you leave.

If you do not note a defect at pickup, the equipment is presumed to have been received in good working order and free of visible damage.

3. Rental Term, Pickup and Return Times

The rental term begins and ends on the dates shown on your booking. Standard pickup is at 6:00 PM on the start date and standard return is by 2:00 PM on the end date, unless your booking confirmation states a different time. Any change to those times must be agreed with us in writing before it takes effect.

Return times are firm because another customer may be scheduled to take the equipment. You must return the equipment by the stated time, clean, and with all accessories.

4. Rental Fee, Taxes and Payment

You agree to pay the daily rental fee for the equipment as listed on our website or on your booking confirmation. If a generator or other additional equipment is required, additional fees apply. Applicable sales tax is added to your rental.

Payment is due as stated on your booking confirmation or invoice. A booking is a request to rent and is not final until we confirm it. Amounts shown at the time of booking are estimates and may be adjusted for actual rental dates, delivery distance, taxes, fuel, cleaning, damage, or additional charges. Balances not paid when due may be subject to additional charges.

5. Security Deposit and Post-Rental Charges

We do not require a security deposit at the start of the rental. However, you acknowledge and agree that we reserve the right to charge a security deposit or impose additional charges after the rental period if any damage to the equipment is discovered, or if any equipment or components are missing. Any such charges will be based on the cost of repairs or replacement and will be communicated to you in writing.

You authorize us to charge any amounts owed under this Agreement to the payment method on file for your booking.

6. Generator, Fuel and Accessories

If a generator is provided, it will be given to you full of fuel. You are responsible for the fuel used during the rental period and must return the generator full. Failure to do so will result in a $6 per gallon surcharge for the fuel needed to refill it. Fuel used must be premium grade and/or ethanol-free.

Any additional equipment or accessories included in the rental must be returned in the same condition as received.

7. Intended Use, Destination and Towing Requirements

You agree to tell us what the equipment will be used for and where it is going. You must inform us of the destination before pickup.

The equipment must be transported using an appropriate vehicle capable of handling its weight and dimensions, equipped with a working trailer brake controller. You agree not to overload the equipment beyond its rated capacity and not to exceed the manufacturer's towing and speed limits.

8. Hitch, Towing Accessories and Driver Requirements

You are responsible for ensuring you have the appropriate hitch and transportation method for the equipment. If you need additional transportation accessories, you must notify us in advance and an accessory rental fee will be added to your final invoice.

The individual operating or transporting the equipment must possess a valid driver's license and have experience handling similar equipment.

9. Insurance Requirement

You must maintain insurance coverage for the rented equipment and any attached vehicle, with minimum coverage limits as required by law. You must provide us with proof of insurance before taking possession of the equipment, and you confirm that coverage is in force and will remain in force for the rental period.

Damage, loss, or theft not covered by insurance remains your financial responsibility.

10. Renter's Care, Maintenance and Reporting Duties

You agree to promptly notify us of any damage, malfunction, or accident involving the equipment.

You must perform the regular maintenance tasks described in our rental support material during the rental period, such as checking fluid levels, checking tire condition, and keeping the refrigeration vents clear. You agree to follow all procedures in that material.

You acknowledge and agree that you are solely responsible for any damage to the equipment during the rental term, regardless of fault, except for damage caused solely by our negligence or by a defect present at pickup that you reported.

11. Equipment Breakdown and Mechanical Failure

We warrant that the equipment is in good working order when you receive it. If the equipment breaks down or a mechanical, electrical, or refrigeration failure occurs during the rental period through no fault of yours, your exclusive remedy is, at our option: (a) repair of the equipment within a reasonable time, (b) a replacement trailer of comparable size and capability if one is available, or (c) a pro-rata refund of the rental fee for the full days you could not use the equipment. This remedy is in place of all other remedies, and our total responsibility for a breakdown is limited to that remedy.

You must stop using the equipment and notify us immediately using the emergency contacts in this Agreement when any malfunction, warning light, unusual noise, temperature rise, or other problem appears. You must not continue to operate equipment that is not working properly.

You must not attempt repairs yourself, and you must not authorize or pay for repairs by any third party without our prior written approval. We are not obligated to reimburse unauthorized repairs.

We are not responsible for delays, missed deadlines, spoiled or damaged contents, lost business, lost profits, or any other loss arising from a breakdown, mechanical failure, or the time needed to repair or replace the equipment. You are responsible for having your own contingency plan, including backup refrigeration or power, for anything you store in the equipment.

You are responsible for damage or failure caused by misuse, neglect, overloading, improper fuel, failure to perform the maintenance described in Section 10, continuing to operate the equipment after a malfunction or after we told you to stop, or towing at excessive speed. In those cases you are responsible for the cost of repairs, and no refund is owed.

The equipment is provided as a refrigerated storage and transport unit only. We do not guarantee that it will maintain any particular temperature in extreme heat, direct sun, high altitude, or when overloaded, when the door is opened frequently, or when the unit is not properly powered. You are responsible for monitoring the temperature of your contents.

12. Damage, Loss and Theft

You are responsible for the equipment from the time you receive it until it is returned to us. You agree to pay for any damage, loss, or theft beyond normal wear, and for any traffic or parking violations incurred during your rental period.

In the event of significant damage to the equipment, you agree to pay us an amount equal to 125% of the purchase value of the equipment.

You must not attempt repairs yourself. Report any damage, accident, or theft to us immediately and, where applicable, file a police report.

13. Cleanliness

You will receive the equipment clean and ready for use. Upon return, the equipment must be clean, both inside and out. If the equipment is not returned in a clean condition, you will be subject to an additional cleaning fee.

14. Late Return Policy

You must return the equipment by the agreed-upon date and time (by 2:00 PM on the return day unless your booking expressly states otherwise). A late fee of $100 per hour or $500 per day applies if the equipment is returned late.

If the equipment is not returned in time for a subsequent customer, you are additionally liable for our lost revenue related to that customer, along with applicable fees.

We are not liable to you for any damages if a prior renter has not returned equipment on time and the trailer is therefore unavailable on your reserved date. In that situation, our only obligation is to refund amounts you paid for the affected rental days.

15. Cancellations and Refunds

If you cancel the reservation less than 30 days before the start of the rental period, a cancellation fee of 50% of the total rental cost applies. Cancellations more than 30 days before the start date are refunded in full.

Contact us as early as possible if your plans change so we can discuss your options.

16. Prohibited Uses

  • Do not use the equipment to transport hazardous materials, illegal substances, or anything that violates local, state, or federal law.
  • Do not sublet, lend, or transfer the equipment to another party.
  • Do not use the equipment for any purpose other than refrigerated storage and transport.
  • Do not take the equipment outside the state of Utah without our written consent.
  • Do not remove, alter, or cover any of our branding, identification, or tracking equipment.

17. Security Measures

You must ensure the equipment is securely locked and any alarm systems are activated when not in use, and that it is kept in your possession or control throughout the rental period.

18. Assumption of Risk and Liability Waiver

You assume all responsibility for any injuries or damages that may occur during the rental period, except those caused by our negligence. You acknowledge that towing and operating a trailer involves inherent risks, and you accept those risks.

19. Indemnification

You agree to defend, indemnify, and hold harmless FrostBox Rentals LLC and its members, employees, and agents from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of your use, possession, or towing of the equipment, your breach of this Agreement, or any act or omission by you or anyone using the equipment with your permission — except to the extent caused by our own negligence.

20. Spoilage, Cargo and Third-Party Property

We are not responsible for any spoilage of contents stored within the rented equipment, or for any damage to property or goods being transported or associated with the rental. We do not carry insurance on your contents, and you are responsible for insuring anything you store or transport.

We are not responsible for damage to your towing vehicle, to third-party vehicles or property, or to any person, arising from your towing or use of the equipment.

21. Limitation of Liability

To the fullest extent permitted by law, FrostBox Rentals LLC is not liable for indirect, incidental, special, or consequential damages, including lost profits, spoiled contents, or business interruption, arising from your use of the equipment or our services. Our total liability under this Agreement is limited to the amount you paid for the rental giving rise to the claim.

Nothing in this Agreement limits liability that cannot be limited under applicable law.

22. Force Majeure and Equipment Unavailability

We are not liable for any failure or delay caused by events beyond our reasonable control, including weather, road closures, accidents, mechanical failure, supply shortages, or the acts of third parties. If the equipment becomes unavailable for reasons outside our control, we may cancel the rental and refund amounts you paid for the affected rental days, which is our only obligation.

23. Text Message Terms

If you opt in to text messages on our booking form, you agree to receive text messages from FrostBox Rentals about your rental, such as booking confirmations, pickup and return reminders, and payment updates. Message frequency varies, up to approximately 4 messages per rental. Message and data rates may apply. Consent is not required to rent.

25. Modifications, Governing Law and Severability

Any modifications or amendments to this Agreement must be made in writing and signed by both parties. Our published terms may be updated from time to time; the version in effect when you book applies to your rental.

This Agreement is governed by and construed in accordance with the laws of the State of Utah. Any dispute will be handled in the courts located in Utah.

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be deemed severed from this Agreement, and the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior agreements, whether written or oral.
